Peak Milk Contest “My Peak Creations!”
Terms and Conditions:
Contest organizer: FrieslandCampina (“Organizer”).
Contest subject:
The Organizer announces Promotion - Contest entitled “My Peak Creations!”, which will be conducted through the Facebook page (https://www.facebook.com/Peakmilk). This Promotion-Contest is designed to reward consumers who use Peak Milk products by conducting monthly draws, in which a number of winners will receive prizes as described below.
This contest, which consists of a Facebook application, is open to all residents of Nigeria who are 18 years of age and above, who are users of the Internet and members/fans of the Peak Milk’s fan page on Facebook (https://www.facebook.com/Peakmilk). Every resident of Nigeria can participate, however the prizes can only be distributed in Lagos. For winners who live outside Lagos, prizes can be picked up at the FrieslandCampina’s office or delivered at a valid Lagos address.
The participation in this Contest implies full acceptance of these terms and conditions, the terms of use of Facebook and any other website used for the participation and conduct of the Contest.
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook and Facebook may in no case be considered liable for anything related with this Contest. You understand that you are providing your information to FrieslandCampina and not to Facebook.
All entries will be checked by the Contest administrator. Any report or comment of participants which has abusive, defamatory or in any way offensive content and rumors for the Organizer or any natural or legal person and any reference offending the good morals or legality, at the sole and absolute discretion of the Organizer, will be excluded from the Contest. The Organizer has also the ability to exclude any Contest participant performing malicious actions in this Contest.
Exclusion of participants:
The employees of FrieslandCampina and of brand Peak Milk and their immediate families (parents, grandparents, children, grandchildren, siblings, in-laws -mother, father, brother, sister, daughter and son- and spouses), the distributor team and relatives, are excluded from the Contest. Any participation of these persons in the Contest in violation of this term shall be considered automatically void.
Activation duration:
The Contest will run from 23/01/2015 at 00:00:01 until 23/04/2015 at 23:59:59 (“Contest period”) with partial draws every month as described below. All entries received outside the Contest period shall be automatically disqualified.
How to Participate in the Contest:
Each participant must make a creation using any Peak Milk products and take a picture of it.
Then the participant must enter in the relevant Contest tab (http://a.pgtb.me/DfXFqq) and upload the photo of their own creation together with a title and a description.
The participant must fill in the form with their personal information.
Any creation will first be approved and the next day, participants will be able to see it in the dashboard of Peak Creations.
The participants can invite their friends to vote their creation or share it in order to get more chances to win. Every share that is clicked by a friend of the participant will receive 10 extra points which increase the chances to become a winner.
Every month one (1) winner will win a Samsung galaxy s5 phone and nine (9) more winners will win goodies bags with Peak products.
The submission of these data takes place entirely at the responsibility of the participants and is a statement of participation in the Contest and an acceptance of these terms and conditions. The file the Organizer will keep with the participants' information will constitute conclusive evidence regarding the participation in the Contest and the validity of such participation, in accordance with the term no 7 below. By entering the Contest and submitting their data, the participants declare that they accept explicitly and unconditionally the messaging (via Facebook and email account) and the phone informing by the Organizer.
Winners will be selected after monthly online draws.
If a participant wins in a draw he/she cannot participate in the next draws again.
The relative draws will take place every month according to the following schedule:
1st draw: 24th of February (for the period 23.01.15-23.02.15) and will announce one (1) winner who will get a Samsung galaxy s5 phone and nine (9) more winners who will get goodies bags with Peak products.
2nd draw: 24th of March (for the period 24.02.15-23.03.15)and will announce one (1) winner who will get a Samsung galaxy s5 phone and nine (9) more winners who will get goodies bags with Peak products.
3rd draw: 24th of April (for the period 24.03.15-23.04.15) and will announce one (1) winner who will get a Samsung galaxy s5 phone and nine (9) more winners who will get goodies bags with Peak products.
As "valid participation" is considered any participation in the Contest for which the following are cumulative:
- Submitted in accordance with the procedure described in term no 6 above.
- Is not a product of illegal technical influences or general fraud or unfair interference of the participant or other person, at the discretion of the Organizer.
- Does not offend good morals.
- Has registered on the relative Facebook application within the period from the start until the end of the Contest.
Prizes:
On each of the three monthly draws ten (10) participants will be selected respectively for ten (10) winners.
The Contest prizes are personalized and the monthly winners do not have the right to exchange them with money or something else or offset them with other offers or another Contest’s prizes in the future.
Election of winners - Receipt of prizes:
Winners’ data will be announced within 5 working days after each draw to the Organizer’s website on Facebook and winners will be notified by the Organizer by telephone or by comment or by a relevant post on Facebook timeline. Winners will have to send a private message to the Peak Milk’s Facebook page giving their full name and surname again as they did in the App, a phone number in which they can be reached and a valid Lagos address.
If the eligible prize winners of each draw do not contact the Organizer within 10 working days since the day of the notification for any reason (including force majeure) or refuse the prize, these people permanently lose their right of the relevant prize and it will be automatically returned to the Organizer, who will be entitled to resume the draw or dispose otherwise the prize or not further dispose it.
Prizes will only be distributed in Lagos. For the winners who live outside Lagos, prizes can be picked up at the FrieslandCampina’s office or delivered at a valid Lagos address. The winners will receive their prizes using a proof (identity card/international passport). The prize will be delivered to each winner upon agreement, unless there is a special announcement for the receiving of the prizes from a specific space for all the winners.
The Samsung Galaxy S5 phones can only be picked up by the winners at the FrieslandCampina’s office, using a proof (identity card/ international passport). The phones will be delivered according to the stock availability of the Nigerian market. Best possible efforts will be made for delivery in 30 days after each draw, but the delivery may be later than the 30 days.
Participants are required to act lawfully and within the context of good morals. The participation in this Contest implies the explicit and unconditional consent of the participants for entry of personal data, which will be kept on a file by the Organizer for the purposes of this promotion and for the required time for the purpose. Participants provide the explicit consent and authorization to the Organizer for the promotion’s and its results exposure, including the identity of the winners, through the radio and through the printed and electronic press or the internet, without paying any fees or compensations. Thus the Organizer reserves the right to use and publish the winners' names and might use any news item relating to this promotion for advertising purposes and the participation in this Contest automatically provides the consent and assignment of the necessary copyright free. All the submitted materials (images and descriptions of the artworks) may also be used by the Organizer for any advertising purposes, including publishing the creations to any media even mentioning the name of the creator and the story of this creation that the participant might write in this Contest. By participating to this Contest any participant provides full rights for re-using images or creations uploaded by him/her and participant cannot claim in the future any liability or damage (financial or other) whatsoever. Also, the Organizer may communicate with the participants if necessary during the Contest period or after the end of the Contest.
The Contest participants by entering their participation explicitly accept these terms and conditions as essential and are solely responsible for the registration of their real data and their participation in the Contest. The participants may not lay any responsibility on Facebook and the Contest Organizer for the validity of entries, the validity of the draw and anything related to the conducted Contest, as this is a promotion. Also, the Organizer will not be liable of any interruption or problem during the transaction of the Contest due to a malfunctioning of the website of Facebook. The participation in this Contest requires the contestants’ access on the internet by their own technical resources and costs and does not create any rights against the Organizer or his property, including the intellectual and industrial property. The Company FrieslandCampina (manufacturer of Peak Milk products) takes no responsibility for the conduct of the Contest, as it is executed by external collaborators who are liable for the proper conduct of this contest.
The Organizer reserves the right to modify in any way these terms of use, such as, but not limited, to postpone the dates of the Contest, to change the offered prizes according to its discretion and cancel the Contest for any reason, informing the public through the Company's fan page on Facebook and by all appropriate means, without any liability to any person, competitor or not.
The Contest administrator has the right to choose which of the fans’ photos (uploaded on the application) will appear on the dashboard of Peak Creations.
After the end of the Contest and the distribution of the prizes, as mentioned above, any obligation of the Organizer towards the Contest participants cease to exist.
